Article 1: Field of application
The general sales conditions apply exclusively to current and future business relations between ADISAYAM (“us”) and the person placing the order (“you”).
These general sales conditions set out to specify the rights and obligations of the buyer with regards to the products sold in the ADISAYAM.com electronic catalogue. Should an actual order be placed, the contract between us and you is subject to the rules of Internet sales and subject to French law (including articles L121-16 and L121-20 of the Consumer Code). The products and prices on the site ADISAYAM.com are valid as long as they’re visible on the site and in the limit of available stock.
ADISAYM may at any time modify these general conditions of sale provided that such modifications appear on the site www.adisayam.com.


Article 2 : Products
Products may be added and removed from the adisayam.com electronic catalogue without prior notice.
Artisanal products are subject to slight variations in shape, weight, size, and color.
The photographs and texts presenting the products offered in the adisayam.com electronic catalog are not contractual and ADISAYAM is not liable to the buyer in case of error.
The products offered are in conformity with French law currently in force. ADISAYAM cannot be liable in the case it or its products fail to respect any laws of another country where the products are delivered. It is the buyer’s or receiver’s responsibility to verify with respect to local authorities the possibility to import or to use these products.
ADISAYAM cannot be held responsible for any accident or damage that may occur when its products are being used.
The products offered in the adisayam.com catalogue benefit from the legal guarantee against concealed defects provided for in articles 1641 and following of the Civil Code.

Article 3: Ordering

We agree to accept your offer under the present general sales conditions. Please note that we are able to fill your order only within the limit of available stock. When you place an order we inform you as to the availability of the products that you wish to purchase. Nevertheless, if, in spite of our attempt to have sufficient stock, the products you order are temporarily unavailable (out of stock, etc.), we will automatically cancel your order and will inform you of such by e-mail.
By confirming your order you accept the totality of the general sales conditions presented to you on this site, acknowledge that you are perfectly aware of the terms and conditions, and therefore agree that you cannot bring forth documents that might go against these terms and conditions, in particular your own general sales conditions. The act of purchase involves accepting these general sales conditions. This confirmation as well as the totality of data that you will have sent us constitute proof of transaction between you and us.

Article 4: Price
The prices indicated in euros include all taxes excluding freight charge and the treatment of your order. We reserve the right to modify our prices at any time, however, we agree to apply the prices that are indicated at the time that you place your order. The prices indicated are guaranteed until 31 December 2007.
Customs taxes, applicable in certain countries, are at the expense of the client (outside of the European Community).

Article 5: Payment
The price is payable immediately at the time the order is placed. You can make your payment by bank card, by check, or by money order. Cards from banks outside of France must absolutely be international bank cards.
Information relative to your bank card (name, type of card, number, and expiration date) is transmitted directly to the PAYPAL server through secured SSL. That server verifies the information supplied by the appropriate payment center (Carte Bleue, Visa, Eurocard-Mastercard) then validates (or not) the transaction without registering the confidential information. At no time do we become aware of that information; that information is never registered with us.

Article 6: Delivery, freight charge, delivery time
Unless stipulated otherwise, delivery is made to the address that you’ve indicated on your order. You are responsible for any risks from the moment that the ordered products have left our premises. Delivery times given are only approximate examples unless, exceptionally, we have undertaken to respect a specific delivery date. Unless otherwise stipulated, delivery is made by the post office and the tracking number of your package will be sent to you by e-mail.
In order to avoid delivery costs and to accelerate the purchase of your article, you can place an order on the site and then come pick up your purchase directly at the Culture(s) pick-up location in Paris by indicating, prior to validating your order, your intent to do so. The Culture(s) pick-up location is located at 46 Rue de Lancry – 75010 Paris. Closest metro station: Jacques Bonsergent. Opening times: Tuesday-Saturday, 11am-8pm.

-Freight charge:
The buyer must pay an obligatory freight and packaging charge of:
for France: 6.20 euros for all orders under 100 euros; freight charge is waived for all orders equal to or above 100 euros.

-Delivery time: delivery typically varies between 2 and 3 business days as from validation of your order for France. This is the average delivery time that can vary between destinations, means of delivery, and availability of the article ordered. Any delivery time beyond this cannot give rise to cancellation of the order or reduction in the price paid by the buyer, or to any damages or interest provided that the delivery is made within 30 days, i.e. 21 business days, following confirmation of the order.


Article 7: Cancellation policy
According to the terms of article L.121-16 of the Consumer Code, the consumer has a period of 7 business days from the date of delivery of his order in which to return any item that doesn’t suit him and to request exchange or reimbursement without penalty, with the exception of the expense of returning the item.
Beyond this 7-day period the delivered products are considered to be in keeping with your order and to be accepted by you.

Article 8: Reservation of ownership
The products delivered will remain our property until you’ve fulfilled all of your obligations with respect to us, particularly until full payment of the price. This reservation of ownership does not prevent the transfer of risks that will be your responsibility as from the time that the ordered products have left our premises in accordance with the provisions of article 6.


Article 9 : Purchase warrantee
The merchandise sold travels at the buyer’s risks and perils. It is recommended that you verify the full contents of the package and note your reservations to the deliverer or refuse the merchandise in case of doubt. An article may be exchanged or reimbursed if it is returned intact, without having been worn, within a period of 14 days (according to the provisions of article L121.16 of the Consumer Code) and in its original packaging.
The cost of sending and returning the merchandise remains the responsibility of the buyer. If you return an item to us due to an error on our part the freight charge will be fully reimbursed upon request.


Article 10: Protection of personal data
In accordance with the French law of computer data and freedom of 6 January 1978, you have a right to access and to rectify any information that concerns you. Article 11: Liability
The characteristics of our products may be modified or improved at any time. The texts and photographs contained in the on-line boutique and illustrating the presented article cannot be considered as contractual.

Article 12: Intellectual property
All texts, commentary, illustrations and images contained in the on-line boutique are protected by copyright worldwide.

Article 13: Governing law and competent court.
These general sales conditions are subject to French law. Any dispute arising from commercial relations between you and us are subject to the exclusive competence of the French courts.
